Please read the following disclaimer carefully before registering on the assessment tool. By registering on the assessment tool, the business entity agrees to abide by the guidelines and the terms and conditions set forth in this disclaimer (collectively the ‘terms’). These terms form an electronic record and do not require any physical, electronic or digital signature and is a legally binding contract between QCI, ONDC and the business entity.
  1. Registering on the assessment tool does not imply that the entity has been recognized or approved by QCI or ONDC for the activities undertaken and will not substitute any legal requirement (by Centre or State/UT) for setting up or operating a business. The entity is responsible for ensuring compliance with all applicable laws and regulations.
  2. Neither the entity nor their sponsoring entity, if any, can advertise/propagate or otherwise claim that they are recognized or approved by QCI or ONDC merely by registering on the assessment tool.
  3. Participation and registration on the assessment tool is voluntary. While registering, entity should understand and agree that they are participating in this initiative on their own volition and agree to the use of any means to verify their assessment process.
  4. Entities shall provide authentic, accurate and complete information during the registration process including but not limited to personal details, business information and any other details required in the assessment tool.
  5. Entities understand and agree that QCI will collect and process personal and business data/information provided during the registration process in accordance with applicable privacy laws of India. By using the assessment tool, the entity gives their consent to the collection and use of their information.
  6. The entity shall be independently responsible for complying with the obligations pertaining to usage, privacy and other terms as prescribed by QCI and/or ONDC.
  7. The entity shall ensure that they do not impersonate another person while providing information for the purpose of registration and participation in the assessment.
  8. QCI reserves the right to verify the information given by the entity to check their veracity.
  9. Any entity found to have provided the false, misleading, or fraudulent information during the registration process will be subject to legal action as per the applicable laws and regulations, which may include but is not limited to civil and criminal proceedings against the individual or sponsoring entity responsible for fake registration or impersonation and cancellation of the registration. QCI reserves the right to share information about fake registration or impersonation with law enforcement agencies, regulatory authorities and other relevant parties as necessary to take appropriate legal action.
  10. The documents and information displayed in this tool are for reference purposes only and do not purport to be legal documents. Neither QCI nor ONDC make any warranties, express or implied, about the accuracy or completeness of the information, text, graphics, links or other items contained within these. QCI reserves the right to modify or make changes to the contents, or to the information described therein, at any time without any notice. QCI makes no commitment to update the contents on its tool. In case of any variance between what has been stated and that contained in the relevant Act, Rules, Regulations, Policy Statements etc, the latter shall prevail. Commercial use of assessment tool's contents is prohibited without the written permission of QCI.
  11. The entities represent and warrant that the content, information, documents or material submitted is accurate, and use of the same does not violate any law and will not cause injury to any individual or entity and shall fully indemnify QCI and ONDC jointly and severally for any claim if any arises from any such content/information/documents so submitted. Notwithstanding anything to the contrary, you agree to keep QCI and ONDC, including its officers, directors, employees and shareholders, fully indemnified against any and all losses, liabilities, costs, actions, claims, fines, and penalties imposed in respect of these Terms including losses on account of third-party liability and breach of your obligations. QCI has the right but not an obligation to monitor and edit or remove any activity or content. Neither QCI nor ONDC takes any responsibility and/or assumes liability for any content submitted by the entity.
  12. Neither QCI nor ONDC endorses in any way nor offers any representation or warranty and accepts no responsibility or liability for the authenticity, availability of any of the goods or services or for any damage, loss or harm, direct or consequential or any violation of local or international laws that may be incurred by your accessing or using the tool or using the information contained therein or use of artificial intelligence.
  13. In no event shall QCI or ONDC be liable for any direct, indirect, incidental, special or consequential damages including but not limited to loss of profit, business interruption or loss of data arising out of or in connection with the use of this assessment tool or the information so provided or e-certificate issued.
  14. QCI or ONDC accept no responsibility for any errors or omissions, or for the results obtained from the use of this site, tool or platform. All information in this site is provided 'as is', with no guarantee of completeness, accuracy, timeliness or of the results obtained therefrom, and without warranty of any kind, express or implied, including, but not limited to warranties of performance, merchantability and fitness for a particular purpose. Nothing herein shall to any extent substitute for the independent investigations and the sound technical and business judgment of the reader. Laws and regulations are continually changing, and can be interpreted only in light of particular factual situations. Additionally, there are no warranties as to the results obtained from this site, tool or platform.
  15. The assessment results generated by the assessment tool are based on the information provided by the participant. It is the participant's responsibility to ensure the authenticity, accuracy and completeness of the information entered into the assessment tool. Any inaccuracies or omissions may affect the accuracy of assessment results. Any decisions or actions taken based on the assessment results are solely based on information submitted and are at the participant's sole risk.
  16. The assessment tool may incorporate or utilize third-party content, software, or services. Any rights and limitations pertaining to such third-party elements are governed by the respective terms and conditions of those entities. QCI and ONDC disclaim any liability or responsibility arising from the use of third-party components within the assessment tool and the participant’s use of such third-party content shall be at their own risk.
  17. The assessment tool has inherent limitations and may not account for all relevant factors or circumstances. The results may be influenced by various factors beyond the assessment tool's control, such as user input, external variables, or changes in the entities' situation. Therefore, the tool does not guarantee the accuracy, completeness, or applicability of the results. The participants acknowledge and accept that the reliance on the tool is at their own risk.
  18. Any certificate awarded to the participant does not imply any endorsement by, partnership with or any relationship between QCI or ONDC and the participant. Further, the certificate neither warrants nor guarantees entity’s on boarding on the ONDC Network nor the performance, quality or ability of the entity's business practices, products, or services or its future endeavours including business prospects.
  19. QCI reserves the right to modify, suspend, or terminate the assessment tool at any time without prior notice. QCI may also revise these terms and conditions without notice. Continued use of the assessment tool following any modifications constitutes acceptance of the revised terms. In event of any cancellation, the application fee will not be refunded since it is a token fee that doesn’t cover the cost of process and other expenses attached to the assessment.
  20. In case of award of the certificate, the participant agrees to indemnify and hold both QCI and ONDC, its respective directors, shareholders, governing body, council members, chairman, officers, employees, agents harmless from any claims, demands, or liabilities, arising from the use or reliance upon the certificate.
  21. In the event of termination of the existing arrangement between QCI and ONDC, you shall with immediate effect cease to use the assessment tool.
  22. By using the assessment tool, the entity acknowledges that they have read and understood these Terms and agree to the same. These Terms are subject to change without notice and it is the user's responsibility to review the same periodically for any updates.
  23. Subject to the above and notwithstanding anything to the contrary, in no event shall ONDC or QCI or its tool or platform be liable to pay/ refund any amount or compensation to the entity in relation to the assessment or the amount paid for the assessment attempts or in relation to any personal/ business information provided and in no event ONDC or QCI or its tool or platform’s aggregate liability under law, contract, equity, tort or otherwise in relation to registration, assessment or otherwise shall exceed the amount paid by the participant.
  24. The Courts in New Delhi shall have the exclusive jurisdiction for any and all disputes and the governing law shall be laws of India.
